The law requires that municipalities provide housing service to a homeless person. In the Danish Act on Social Services (LBK nr 58 18/01/2007) on shelter services etc. for adults, it is stated:
s 110, ss 1, the local authorities must provide temporary shelter for persons with special social problems and who either do not have or are able to stay in their own home, and who need housing service and activating support, care and subsequent help.
ss 2, Admittance into housing under ss 1 may occur upon personal application or by referral from public authorities.
ss 3, housing/shelter manager will take the final decision on admittance.
In other words, there is an official requirement for providing shelter to a person with special social problems and who does not have, or is not able to stay, in his or her own home.
